Privacy Policy
We take your privacy seriously. This policy explains what we collect, why we collect it, and the choices you have.
Effective May 18, 2026 · Last updated August 9, 2026
1. Introduction
This Privacy Policy describes how Avanta Innovations Corporation (“Avanta,” “we,” “us,” or “our”) collects, uses, discloses, and safeguards your information when you visit our website, create an account, or use Avanta Build and any related applications, mobile apps, APIs, or services (collectively, the “Services”). By using the Services, you agree to the practices described here.
This policy does not cover the mobile games published by our Avanta Games division, which collect no personal information and are governed by a separate Avanta Games Privacy Policy.
If you are located in the Philippines, this policy is intended to comply with the Data Privacy Act of 2012 (Republic Act No. 10173) and its Implementing Rules and Regulations. Where you are located outside the Philippines, additional local laws may apply.
2. Information We Collect
We collect information you provide directly to us, information we collect automatically, and information we receive from third parties.
a. Information you provide
- Account data: your name, email address, phone number, password, company name, role, and country.
- Project data: project names, tasks, schedules, photos, files, expenses, and related content you upload to the Services.
- Billing data: billing address, tax information, and limited payment details processed by our payment providers. We do not store full card numbers on our servers.
- Support data: messages, attachments, and feedback you send when contacting us.
b. Information collected automatically
- Usage data: pages viewed, features used, timestamps, referring URLs, and crash diagnostics.
- Device data: device type, operating system, browser, language, and approximate location derived from IP address.
- Cookies and similar technologies: small files used to keep you signed in, remember preferences, and measure performance. See “Cookies” below.
c. Information from third parties
We may receive information from identity providers (e.g., Google or Apple sign-in), payment processors, analytics providers, and business partners who help us deliver the Services.
3. How We Use Your Information
We use information to:
- Provide, maintain, and improve the Services;
- Create and secure your account and authenticate you;
- Process transactions and send related receipts and notices;
- Send service updates, security alerts, and administrative messages;
- Respond to inquiries, requests, and support tickets;
- Monitor usage, debug issues, and improve performance and reliability;
- Detect, investigate, and prevent fraudulent or unauthorized activity;
- Comply with legal obligations and enforce our agreements.
We do not sell your personal data, and we do not use your project content to train third-party AI models.
4. Legal Bases for Processing
Where required (for example, under the Philippine Data Privacy Act or comparable laws), we process personal data on one or more of the following bases: your consent, the performance of a contract with you, compliance with a legal obligation, protection of vital interests, the performance of a task carried out in the public interest, and our legitimate interests in operating and improving the Services in a manner that is not overridden by your rights.
5. How We Share Information
We share information only as described below:
- With your organization: if you use the Services as part of a team or company workspace, administrators of that workspace may access content and account information associated with it.
- Service providers: trusted vendors who help us host infrastructure, process payments, send emails, provide analytics, and offer customer support, under contractual confidentiality and security obligations.
- AI processing: when you use an AI-assisted feature, the content needed to answer your request is sent to our AI provider. This happens only on your instruction and is described in section 6.
- Legal and safety: when we believe in good faith that disclosure is necessary to comply with the law, enforce our terms, protect our rights, or the safety of users and the public.
- Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to the same protections described in this policy.
- With your direction: when you connect third-party integrations or otherwise instruct us to share your data.
6. Artificial Intelligence Features
Avanta Build includes optional AI-assisted features: generating an activity and task breakdown from a bill of quantities or scope of work you upload, answering questions about your own project data, and drafting a client update from your field reports.
These run only when you ask them to. We do not process your content with AI in the background. When you invoke one of these features, the relevant portion of your workspace content — which may include the document you attached, project and task records, field reports, expense and collection figures, and the names of workspace members associated with them — is transmitted to a third-party AI processing provider that operates in the United States, under a commercial agreement that requires it to keep your content confidential and to process it only to deliver the feature. Only data that your role already permits you to see is included. We will tell you the identity of our current AI provider on request at admin@avanta.com.ph.
Under that agreement, our provider does not use your content to train its models. Neither do we.
We do not keep a server-side record of your AI conversations. The transcript of an “Analyze with AI” thread is stored on the device you asked it on, is scoped to the account and workspace that created it, and is erased when you sign out. Any file an AI feature produces for download is held temporarily — no more than two hours — and then discarded. Content that you choose to save into your workspace, such as an accepted activity breakdown or a client update you keep, is stored and retained like any other content under section 9.
Some AI features offer an optional web search step, which you turn on for an individual request. When you enable it, the search terms derived from your request are sent to a search provider through our AI provider. Leave it off and no part of your request reaches a search engine.
AI output can be inaccurate or incomplete and is provided for your review, not as professional advice. You remain responsible for checking it before relying on it. See section 7 of our Terms of Service. We do not use AI to make automated decisions that produce legal or similarly significant effects about you.
7. Cookies and Tracking
We use cookies and similar technologies to keep you signed in, remember preferences, secure the Services, and understand product usage. You can control cookies through your browser settings; disabling some cookies may affect functionality.
8. International Data Transfers
We are headquartered in the Philippines and may process and store information in the Philippines and other countries where we or our service providers operate. Where data is transferred across borders, we take reasonable steps to ensure it is protected consistent with this policy and applicable law.
9. Data Retention
We retain personal data for as long as your account is active or as needed to provide the Services, comply with legal obligations, resolve disputes, and enforce our agreements. When data is no longer needed, we delete or anonymize it. You can request deletion of your account at any time as described below.
10. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal data, including encryption in transit, access controls, monitoring, and regular backups. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.
11. Your Rights and Choices
Depending on your location, you may have the right to access, correct, update, port, or delete your personal data; to object to or restrict certain processing; and to withdraw consent where processing is based on consent. To exercise these rights, contact us at admin@avanta.com.ph. We may need to verify your identity before fulfilling your request.
Philippine residents have additional rights under the Data Privacy Act, including the right to lodge a complaint with the National Privacy Commission (NPC) at privacy.gov.ph.
12. Children's Privacy
The Services are not directed to children under 16, and we do not knowingly collect personal data from children under 16. If you believe a child has provided us with personal data, please contact us so we can take appropriate action.
13. Third-Party Services
The Services may link to third-party websites or integrate with third-party tools. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing them with personal data.
14. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will notify you by updating the “Last updated” date above and, where appropriate, by sending you a notice through the Services or by email.
